He added: "I hope people see the big picture, see that this agreement could open the way for a normalisation of relations between Iran and the international community." Mr ElBaradei did not disclose details of the plan, but senior diplomatic sources said it was essentially the one agreed in principle at talks earlier this month in Geneva regarding 1,200kg of uranium, around 80 per cent of the total Iran holds. "We are talking about relatively small volumes, between 1 and 2 bcm (per year), but not necessarily starting now, (but rather) for the long term," said Jean-Marie Dauger, who overseas gas and liquefied natural gas business at GDF Suez. "It would be an increase in our Russian gas commitment... Today we have 10 bcm of gas committed from Russia, which are received through Germany. So, it could be that part of these volumes are rerouted to Nord Stream," Dauger said. "But above that, we think we need to have a little more volumes and this is what we are discussing, and these volumes are meant to supply our Northern European markets. The new twist came after Iranian Foreign Minister Manouchehr Mottaki said in Tehran that France was not needed at the talks, which also involve Russia, the United States and IAEA officials. Iran has told the IAEA it needs fuel for a research reactor and a proposal has been made for Russia and France to enrich Iranian uranium. Western powers want greater control of Iran's uranium which they fear is being used to build a nuclear bomb. The agency contacted some countries and the United States and Russia accepted to participate in the negotiations to supply the fuel," Mottaki said. “The negotiations will be conducted with these two countries in the presence of the agency. We do not need a lot of fuel and we do not need thepresence of many countries. There is no need for France to be present. Delegations from France, Iran, Russia, the United States and the IAEA had gathered in the room at the agency headquarters before deciding to delay the start. The teams from Tehran and Paris appeared to make a point of leaving theroom together. And diplomats played down suggestions that the delay was over the foreign minister's comments. "It's just regular diplomacy as delegations try to advance the issues," one diplomat told AFP on condition of anonymity. "It is not about the continued French participation but rather about how to best structure a deal so that everyone can be satisfied. Even beyond the politics this is complicated," the diplomat said. In July 2008, the Belgian-Dutch banking and insurance group Fortis had announced the sale of a portion of ABN's commercial activities to Deutsche Bank for 709 million euros, a requirement under fair competition conditions set by the European Commission. Fortis was itself nationalised in October 2008, a move which included its stake in ABN Amro. Earlier on Tuesday, the German business daily Handelsblatt cited financial sources as saying that Deutsche Bank was interested in subsidiaries of the Italian bank Monte dei Paschi di Siena (MPS). A Deutsche Bank spokesman contacted by AFP declined to comment on what he called "rumours." Deutsche Bank is actively seeking to bolster its retail banking activities and reduce its dependence on a globally significant investment bank unit that is vulnerable to financial market volatility. The German bank is also in talks on taking a stake in compatriot Sal Oppenheim, which specialises in banking services to the wealthy. Those talks are expected to wrap up later this month or in early November. Deutsche Bank has already acquired a minority holding in Germany's Postbank, which has the largest retail network in the country. It is expected to gain full control in the coming years.

A Deutsche Bahn admitiu ter lido correios electrónicos dos empregados para descobrir eventuais práticas danosas em contratos com fornecedores. A Alemanha é muito sensível nas questões de privacidade e o caso levou, em Fevereiro, à demissão do antigo patrão da Deutsche Bahn, Hartmut Mehdorn. Mas o caso da companhia de caminhos de ferro não é único no país. Foram verificados episódios similares em outras grandes empresas germânicas, como a operadora de telecomunicações Deutsche Telekom e o banco Deutsche Bank.

Un fondo de inversión en trámites de registro en la CNmv/ Mark Kurland, fundador de la firma New Castle, fue arrestado el pasado viernes junto a otros cinco implicados por información privilegiada. Los inversores españoles se han librado por los pelos de verse envueltos en un nuevo escándalo relacionado con los hedge fund. La SEC, el regulador de los mercados norteamericanos, detuvo el pasado viernes a seis gestores alternativos relacionados con un caso de información privilegiada. Uno de ellos se encontraba en trámites para registrar uno de sus fondos en la CNMV, paso tras el que iniciaría la comercialización activa entre inversores institucionales españoles. De hecho, el responsable de este hedge fund, New Castle Funds, estuvo el pasado viernes 9 de octubre en el hotel Villa Magna de Madrid presentando su método de inversión entre los principales actores de la gestión alternativa en España. Kurland fue detenido el pasado viernes en una operación en la que la SEC actuó contra otros cinco gestores y directivos de cotizadas norteamericanas. El principal acusado es Raj Rajaratnam, responsable del hedge fund Galleon (ver información adjunta). Este gestor se benefició de información privilegiada de grandes compañías norteamericanas como Google, Hilton y Sun Microsystems para ganar más de 25 millones de dólares (16,7 millones de euros). Por su parte, los responsables del hedge fund New Castle obtuvieron 3,4 millones de dólares mediante operaciones fraudulentas. La SEC ha abierto cargos contra los gestores de New Castle y Galleon, les impondrá multas y obligará a devolver el dinero ganado ilícitamente. Además, estos gestores podrían afrontar penas de cárcel de hasta 20 años, aunque de momento han sido puestos en libertad bajo fianza. El regulador norteamericano emprenderá también acciones contra tres directivos de Intel, McKinsey e IBM. Aunque todavía se desconoce si los ahorradores españoles tenían dinero en estos hedge fund, todo apunta a que el impacto será mínimo. Según los últimos datos del supervisor español, tan sólo un fondo invertía en Galleon. Era el Próxima Centaurii, de la antigua filial de hedge fund de BBVA, que está en liquidación. Por su parte, es previsible que UBP, la encargada de comercializar el fondo de New Castle en España, cancele los planes de registrar el producto en la CNMV. Estaba previsto que el UBAM-New Castle Market Neutral US Equity llegase a España bajo la carcasa de UCIT III, el pasaporte europeo para que un fondo de inversión pueda comercializarse en todo el continente registrándolo en un sólo país. Los expertos empiezan a cuestionar cada vez más el uso de este pasaporte para registrar hedge fund después de que la estafa del estadounidense Bernard L.Madoff se extendiera por los principales centros financieros europeos a través de fondos UCIT III.

Holanda amplía las quiebras bancarias europeas con DSB. Publicado el 19-10-2009 , por Expansión.com. La lista de quiebras bancarias en Europa suma un nuevo nombre, el de DSB Bank. Un tribunal holandés ha declarado hoy oficialmente la bancarrota de la entidad, después de un intenso fin de semana en el que fracasaron todos los intentos de rescate. Las esperanzas de solución para DSB pasaban por un presunto interés desde Estados Unidos. El propietario de la entidad financiera, Dirk Scheringa, anunció el viernes un posible comporador estadounidense. Los contactos no fructificaron, como tampopco los realizados previamente con otras entidades financieras holandesas y europeas. Desde hacía una semana estaba 'intervenido' por el banco central holandés. Su crisis se precipitó con la retirada masiva de fondos. Sus clientes retiraron en diez días unos 600 millones de euros de sus cuentas, el equivalente a una sexta parte de sus depósitos, como consecuencia del llamamiento realizado por una asociación de perjudicados por créditos inmobiliarios de mala calidad. Un tribunal de Amsterdam ha declarado hoy la quiebra del banco. En uno de los últimos intentos de rescate, el Gobierno holandés barajó opciones como la inyección de 100 millones de euros y la conversión de otros 100 millones de euros de depósitos en acciones del banco.

Um morto e vários feridos em despiste de autocarro com estudantes holandeses. Hoje às 09:46. Uma pessoa morreu e várias ficaram feridas quando um autocarro com cerca de 60 estudantes holandeses se despistou e tombou hoje numa auto-estrada da Catalunha, informou a polícia de trânsito.O autocarro, em que também seguiam vários professores, despistou-se por causas desconhecidas cerca das 06:20 (07:20 em Lisboa) na auto-estrada AP-7, perto de Bàscara, na província de Girona. O grupo de estudantes ia passar férias na Costa Brava, no nordeste de Espanha. Ao local do acidente acorreram ambulâncias e efectivos da polícia e dos bombeiros para resgatar os feridos, que ficaram encarcerados no autocarro sinistrado. Os feridos foram transportados para um hospital da cidade de Girona e para outro na localidade próxima de Figueras.

Распилить за один день. Мастер по приему пиломатериалов может отпилить от государственного бюджета 5,4 млрд руб. без помощи налоговиков и милиции, считает российский суд. Фонд Hermitage, который пострадал в этом деле вместе с государством, исключает такую возможность и провел собственное расследование19.10.2009, 197 (2467) В мае вступил в силу приговор Тверского районного суда Москвы в отношении гендиректора ООО «Парфенион» Виктора Маркелова, который признан виновным в хищении путем обмана 5,41 млрд руб. у государства. Такую сумму налога на прибыль в декабре 2007 г. московские инспекции № 25 и № 28 согласились вернуть «Парфениону», а также ООО «Рилэнд» и ООО «Махаон», в которых Маркелов был участником (в момент вынесения приговора Маркелов работал мастером по приему пиломатериалов ДОЗ-160 «Лестехинвестпрома»). Суд признал, что Маркелов действовал не в одиночку, а «в группе», но«неустановленных лиц». Руководители инспекций и их сотрудники признаны судом лицами, «введенными в заблуждение». Маркелов получил пять лет колонии общего режима без денежного штрафа. В распоряжении «Ведомостей» оказались материалы альтернативного расследования этого мошенничества, проведенного компанией Hermitage Capital Management, консультантами фонда Hermitage. Они направлены министру финансов, руководителю Федеральной налоговой службы (ФНС), генпрокурору, председателям Следственного комитета при прокуратуре, Счетной палаты и Центробанка. По мнению Hermitage Capital, Маркелов не смог бы совершить преступление без помощи сотрудников ГУВД по Москве и инспекций № 25 и № 28. До 2006 г. компании «Парфенион», «Рилэнд» и «Махаон», бывшие «внучками» HSBC Private Bank, использовались Hermitage для сделок с акциями. Hermitage утверждает, что в 2007 г. они были украдены у компании и перерегистрированы на казанское ООО «Плутон», соответственно, у компаний появились новые гендиректора — Маркелов, Вячеслав Хлебников и Валерий Курочкин. Необходимые документы и печати, как утверждает Hermitage, мошенники получили от сотрудников московского ГУВД, которые изъяли их в ходе обысков в офисах компании Firestone Duncan (юридический советник Hermitage). Затем компании были перерегистрированы из московских инспекций ФНС № 10 и № 15 в инспекции № 25 и № 28, а 24 декабря 2007 г. все три ООО подали заявления о возврате переплаченного в 2006 г. налога на прибыль. Оказалось, с октября по ноябрь 2007 г. «Махаон», «Парфенион» и «Рилэнд» проиграли однотипные иски в судах Петербурга, Москвы и Казани о компенсации упущенной выгоды в сумме на 30,7 млрд руб. Решения суды приняли быстро, ведь представители трех ООО согласились с исками. С учетом платежей по искам работа компаний в 2006 г. из сверхприбыльной оказалась убыточной, а значит, они имели право вернуть из бюджета уплаченный налог на прибыль. Hermitage обращает внимание на скорость, с которой трем ООО были возвращены 5,4 млрд руб. налогов. Заявления от гендиректоров поступили 24 декабря 2007 г. и в тот же день были одобрены руководителями обеих инспекций. А уже 26 декабря вся сумма была переведена казначейством на счета компаний. В материалах дела есть допросы замначальника ИФНС № 25 Сергея Жемчужникова и начальника отдела ИФНС № 28 Ольги Цымай. Из них следует, что в течение рабочего дня они успели провести все необходимые проверки. Удостоверились, что компании, подавшие иски к «Махаону», «Парфениону» и «Рилэнду», сдавали «не нулевую отчетность» и отражали полученные от них активы, что банки проводили эти расчеты. Проверили, что договоры, лежавшие в основе исков, подлинные, а также запросили московское ГУВД, являются ли Маркелов, Хлебников и Курочкин теми, за кого себя выдавали. Hermitage обнаружил сразу несколько противоречий в этих показаниях, говорит представитель фонда. Так, «Эйч-эс-би-си банк» (в нем держали расчетные счета все три ООО) ответил, что в декабре не получал от налоговых инспекций запросов (копия письма есть у «Ведомостей»). Отчетность ЗАО «Логос плюс», ООО «Инстар» и ООО «Гранд актив», сданная в Росстат, показывает, что у компаний была нулевая дебиторская задолженность. Также у «Ведомостей» есть копия документа от 14 декабря 2007 г., в котором прокуратура Москвы подтверждает, что направила жалобу Hermitage на кражу компаний в ГУВД Москвы для рассмотрения. Наконец, решение Арбитражного суда Москвы по иску «Инстара» к «Рилэнду» (на $312 млн) вступало в силу только 11 января 2008 г., т. е. спустя 18 дней после решения инспекции о возврате налога. Решение о возврате НДС принимает специальная комиссия регионального управления ФНС, а по налогу на прибыль такой комиссии нет, рассказывает сотрудник московских налоговых органов. Но миллиардные суммы, конечно, проходят через профильный отдел управления, и это занимает не один день. Деньги из казначейства также идут через управление, добавляет он. Механизм согласования сумм с управлением подтверждает и другой сотрудник налоговых органов, отмечая, что для подстраховки возврат миллиардных сумм может неформально согласовываться и с ФНС, так как по прибыли возврат миллиардов рублей — редкий случай, который может «броситься в глаза» во время проверки. Казначейство одобряет запрос налоговой на возврат налога на прибыль автоматически, объяснил «Ведомостям» министр финансов Алексей Кудрин. Все потому, что в отличие от НДС налог на прибыль большей частью идет в региональные бюджеты, говорит он. По его словам, региональные налоговые управления обязаны без всякого согласования с ФНС возвращать налог, а регионы, у которых из-за этого выпадает часть доходов, могут взять в Минфине кредит под 2,5% годовых на три года. Hermitage считает, что случаи с компаниями HSBC были не единичными. В 2006-2007 гг. московские инспекции № 25 и № 28 вернули 2,9 млрд руб. ООО «Финансовые инвестиции» и ООО «Селен секьюритиз», которые предварительно также проиграли в судах дела об упущенной выгоде. В этой истории засветились люди, участвовавшие и в деле Маркелова. Так, Алексей Шешеня был учредителем и ООО «Полет», подававшего иски к «Финансовым инвестициям», и «Гранд актив», подававшего иски к «Парфениону». А Геннадий Плаксин был учредителем «Оптим-сервиса», выигравшего иски у «Селен секьюритиз», учредителем «Инстара», выигравшего иск к «Рилэнду», и предправления Универсального банка сбережений, на счета в котором переводились возвращенные налоги в обоих случаях (банк самоликвидировался в 2008 г.). «Ведомости» в пятницу направили запросы в ФНС, УФНС по Москве и ГУВД по Москве с просьбой прокомментировать эту историю (и обязательно опубликуют эти комментарии, если они будут даны). Аналогичные запросы, отправленные в декабре 2008 г. ФНС, УФНС по Москве, инспекциям № 25 и № 28, остались без ответа. Представитель УФНС по Москве объяснил, что «данные сведения составляют налоговую тайну, а потому не подлежат разглашению».

Суд отложил арест главы МВД Бурятии. Басманный суд Москвы отложил на 20 октября рассмотрение ходатайства следствия об аресте министра внутренних дел Бурятии Виктора Сюсюры, подозреваемого в контрабанде. Такое решение суд принял по ходатайству следователя, который просил отложить рассмотрение ходатайства на 72 часа для предоставления доказательств, подтверждающих его обоснованность. «Судья продлил срок задержания Сюсюры и назначил заседание по рассмотрению ходатайства следствия на 20 октября, — сообщила ИТАР-ТАСС руководитель пресс-службы Мосгорсуда Анна Усачева. — В настоящее время суд приступил к рассмотрению ходатайства следствия об избрании меры пресечения в виде заключения под стражу в отношении заместителя министра внутренних дел Бурятии Шарыпова». По данным программы «Вести-Дежурная часть», задержание было произведено 17 октября в Улан-Удэ в рамках уголовного дела о контрабанде, которое ведёт Следственный комитет при прокуратуре РФ. В кабинете высокопоставленного чиновника и у него дома прошли обыски. Утром в воскресенье под усиленной охраной Сюсюра был доставлен в Москву в следственный изолятор «Лефортово». Вместе с главой МВД Бурятии был задержан и исполняющий обязанности начальника управления по налоговым преступлениям республиканского МВД Андрей Шурупов. По предварительным данным, претензии правоохранителей к Виктору Сюсюре связаны в основном с его предыдущей службой. До назначения на должность министра внутренних дел Бурятии он возглавлял Азово-Черноморское управление внутренних дел на транспорте. При Викторе Сюсюре, согласно официальным данным, сотрудники УВДТ провели ряд успешных операций по изъятию контрабандных грузов. Однако есть и неофициальная информация: Виктор Сюсюра оказывал покровительство тем же самым контрабандистам. «По сообщениям некоторых СМИ, и в Бурятии у Виктора Сюсюры был свой интерес. В частности, используя служебное положение, он проявил явно неправоохранительное внимание к добыче нефрита. На этом в Бурятии делаются огромные деньги, большая их часть “крутится” в теневом бизнесе», — сообщили в программе «Вести недели» телеканала «Россия». Но на словах Виктор Сюсюра позиционировал себя в качестве непримиримого борца с преступностью. На недавней коллегии МВД республики Бурятия Сюсюры рапортовал о снижении уровня преступности в Бурятии. «Сегодня, по истечении девяти месяцев текущего года, мы можем в очередной раз и уже традиционно с чувством взаимного удовлетворения констатировать тот факт, что преступность в республике продолжает неуклонно снижаться», — отчитался генерал-майор милиции о проделанной работе накануне своего задержания, передают «Вести». Полковник милиции Виктор Сюсюра был назначен пост главы МВД Бурятии указом президента России Владимира Путина 28 марта 2006 года. Указом президента Российской Федерации от 11 июня 2008 года министру внутренних дел по Республике Бурятия, полковнику милиции Виктору Сюсюре было присвоено звание генерал-майора милиции. Виктор Сюсюра имеет несколько наград за отличную службу, а также орден «За заслуги перед Отечеством» II степени.
